IBM ordered to post $3 million bond in case to keep employee from going to work at Apple

A federal judge has ordered IBM, which is trying to block a former company executive from taking a job with Apple, to provide a US$3 million bond to keep the case going, reports Computerworld. In an order signed Wednesday, but posted to the federal court system’s database Friday, U.S. District Court Judge Kenneth Karas instructed IBM that it must file the bond by 5 p.m. EST.
The $3 million bond is designed to pay for any costs or damages that Papermaster might suffer if it’s later determined that IBM wasn’t entitled to an injunction, the article adds. On Nov. 11 it was announced that Mark Papermaster was joining Apple as senior vice president of Devices Hardware Engineering, reporting to CEO Steve Jobs. Papermaster was tapped to lead Apple’s iPod and iPhone hardware engineering teams. He was previously a vice president at IBM.
IBM believes his hiring is an attempt to expand Apple’s presence in the markets for servers and chips for handheld devices. Big Blue is suing Papermaster to prevent him from joining Apple and divulging trade secrets related to IBM’s Power chips and server products, according to the complaint filed in the U.S. District Court for the Southern District of New York.
