Apple TV 3.0 software on the way

A new terms of service agreement has been posted up for iTunes users to approve when purchasing songs, movies or apps—along with a mention that Apple TV 3.0 software is on the way, reports TUAW.
It reads: “The Terms of Sale have been revised to clarify that you can now use iTunes LPs and iTunes Extras on Apple TV with software version 3.0 or higher.” The Apple TV software is currently at version 2.4.
Okay, Apple, now how about some new Apple TV hardware?
