Another day. Another lawsuit. A lawsuit has been filed against Apple over what the plaintiff is referring to as the “defective iPhone 3G,” which she hopes will become a class-action complaint. Alabama resident Jessica Alena Smith filed the complaint Tuesday, alleging that the new iPhone’s 3G performance and reliability has been unacceptable.
The lawsuit alleges that, despite Apple’s advertising and marketing claims, that the iPhone 3G is “twice as fast for half the price,” it’s actually slower than advertised and prone to dropping calls.
“Apple sold these devices on the promise that they were twice as fast as the pre-existing phones and that they would function properly, on the 3G network,” Jonathan Kudulis, an attorney with Birmingham, Alabama-based Trimmier Law Firm, told ABC News. Trimmier is representing Smith.
The Ars Technica had this to say about the lawsuit: “Considering that a true fix has yet to be issued for users’ 3G problems, this could just be the tip of the iPhone lawsuit iceberg.”

I have a 3g iphone. There’s tons of potential, but the AT&T;network can only be described as abysmal—and I’m very dissapointed in the service. Little to no internet capability most places in Manhattan. Apple takes such pains to control which third party apps get into the app store to preserve the functionality of the device; meanwhile, connectivity stinks. They should have gone with Verizon.
