Apple files trademark suit against iPod Mechanic

imageAnother day, another lawsuit. The CBR web site reports that Apple has filed a lawsuit against a Michigan iPod repair company, iPod Mechanic, alleging that it misused Apple’s “Pod” and “iPod” trademark through the name of the business and its accompanying web site.

The company said iPod Mechanic’s owner Nicholas Woodhams didn’t have permission to use the trademark. Woodhams had allegedly agreed to stop using the term in 2006 and had reached an agreement with Apple to drop the iPod Mechanic name by January 2007, but didn’t, notes CBR

According to the suit, Woodhams also took advantage of Apple’s iPod Shuffle Advance Replacement Program. Apple alleges that Woodhams would submit a repair claim to Apple and receive advance units in return, but did not return the broken units. Apple claims that Woodhams then went on to repair the units and sell them at a huge discount. It also alleges that Woodhams switched the back plates of out-of-warranty iPods for those of still-covered models.
